Mexican Senate adopted an “interpretive declaration” when ratifying the UN Convention

The Ratification of the new Convention on the Rights of Persons with Disabilities by the Senate of Mexico on September 28 was cause for celebration by many people with disabilities, families and organizations. However, the Mexican Senate adopted an “interpretive declaration” which stipulates that where there is a conflict between Article 12 paragraph 2 (guarantee of equal legal capacity) and national laws, they will apply the standard which provides "the best legal protection, safeguards dignity and ensures the physical, psychological, emotional and patrimonial integrity of persons." CONFE, our member in Mexico have been working hard to try to reverse the Mexican Senate decision to issue an interpretive declaration to article 12. A parent, who is also a journalist, has helped to attract a lot of media attention and our representatives have appeared in important Mexican media, including CNN. CONFE together with a number of other Mexican NGO's have published an open letter in the newspaper 'EL UNIVERSAL' calling on Mexico to respect the principle of self-determination and ratify the Convention without any limitation.
